- That the Platform will be uninterrupted, error-free, secure, or available at all times.
Users are responsible for conducting their own checks, interviews, reference checks, screening, verification and legal compliance before making recruitment, employment, payment or other decisions.
2. Eligibility and authority
You may use the Platform only if you:
- Are at least 18 years old, or have valid consent from a parent, guardian or lawful representative where permitted;
- Have the legal capacity to enter into a binding agreement;

You must not use the Platform if you are prohibited from doing so by applicable law or have previously been suspended or removed by myindianz.
3. Accounts and security
You may need to create an account to access certain features. You agree to provide accurate, complete and current information and to update it promptly.
You are responsible for maintaining the confidentiality of your login credentials; all activity that occurs through your account; ensuring that persons using a business account are authorised; and notifying us promptly at info@myindianz.com if you suspect unauthorised access, loss of credentials or account misuse.
You must not share account credentials, impersonate another person, create accounts using false information, bypass access controls, or use another person’s account without permission.
We may suspend, restrict or close an account where we reasonably believe there is a security risk, breach of these Terms, unlawful conduct, fraud, inaccurate information, or risk of harm to users or the Platform.

- You will independently evaluate each employer, recruiter and opportunity before sharing additional information, attending interviews, accepting offers or making payments; and
- You will not ask for, accept or make improper payments in connection with employment opportunities.
Your use of the Platform does not create an employment relationship, agency relationship, or guarantee of employment with myindianz or any business user.

- You will keep candidate data secure, restrict access to authorised personnel, not sell or misuse it, and delete or anonymise it when no longer needed;
- You will not use candidate data for direct marketing, profiling, training artificial-intelligence models, identity theft, harassment, discrimination, or any purpose unrelated to the recruitment purpose unless you have a lawful basis and have given required notice or obtained consent;
- You will not export, scrape, bulk-download, share or retain candidate data beyond what the Platform permits or applicable law allows;
- You will promptly tell us about suspected data breaches, security incidents, fraud, misuse, or complaints involving candidate data or the Platform; and
- You will comply with any additional order form, subscription agreement, data-processing agreement or employer-specific rules agreed with myindianz.

You retain ownership of your User Content. However, by submitting it, you grant myindianz a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, communicate, transmit and otherwise process that User Content solely as necessary to operate, improve, secure and provide the Platform, perform these Terms, meet legal obligations, and enable the visibility or sharing choices you make.

11. Intellectual property
The Platform, including its software, design, text, graphics, trademarks, logos, databases and other content, is owned by or licensed to myindianz and is protected by applicable intellectual-property laws.
Subject to these Terms, myindianz grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purpose. No other rights are granted.

If you provide suggestions, ideas, feedback or improvements about the Platform, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without your permission.
13. Suspension, termination and survival
You may stop using the Platform and request account closure at any time, subject to any subscription commitments and applicable retention requirements.
We may suspend, restrict or terminate your access, remove content, or take other reasonable action if we believe you have breached these Terms, created risk, acted unlawfully, failed verification, or if we are required to do so by law.
On termination, your right to use the Platform ends. Sections that by their nature should survive will survive, including those concerning intellectual property, privacy, disclaimers, liability, indemnity, disputes and accrued payment obligations.
14. Disclaimer
To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis. myindianz makes no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, or that the Platform will meet your needs.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable law.
15. Limitation of liability
To the maximum extent permitted by law, myindianz and its directors, officers, employees, affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive losses; loss of profits, revenue, business, opportunity, goodwill or data; or losses arising from another user’s conduct, employment decisions, user content, third-party services, unauthorised access, or your use of or inability to use the Platform.
To the maximum extent permitted by law, myindianz’s aggregate liability arising out of or relating to the Platform or these Terms will not exceed the greater of: (1) the amount you paid directly to myindianz for the relevant paid service during the 12 months before the event giving rise to the claim; or (2) RM100.
This limitation does not apply to liability that cannot lawfully be limited or excluded.
16. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless myindianz, its affiliates, directors, officers, employees and agents from claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from or relating to your breach of these Terms; your User Content; your use or misuse of the Platform; your violation of law or another person’s rights; or, for business users, your recruitment activities or handling of candidate personal data.

We may modify, suspend or discontinue any part of the Platform at any time, including features, content and availability.
We may update these Terms from time to time. The revised Terms will be posted on the Platform with an updated “Last updated” date. Where legally required or where changes are material, we will provide additional notice. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
18. Governing law and disputes
These Terms are governed by the laws of Malaysia.
Before starting formal proceedings, you agree to contact us at info@myindianz.com and attempt in good faith to resolve the dispute for at least 30 days. Subject to mandatory law, the courts of Malaysia will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Platform.
19. General
These Terms, together with the Privacy Policy and any applicable order form or additional written agreement, form the entire agreement between you and myindianz regarding the Platform.
If a provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a corporate transaction, restructuring, transfer of business or by operation of law.
Our failure to enforce a provision is not a waiver. You and myindianz are independent parties; these Terms do not create a partnership, employment, agency, franchise or joint venture.
